3. Service Terms
Eligibility
Services are available to individuals 18 years or older. By engaging our services, you confirm you meet this requirement.
Service Delivery
We provide design services as described in our service agreements. Timeline estimates are approximate and may vary based on project complexity.
Client Responsibilities
Clients must provide accurate information, timely feedback, and necessary access to spaces for assessment and implementation.
4. Payment Terms
Payment terms are established in individual service agreements. Generally:
- • Consultation fees are payable in advance
- • Design services typically require a deposit before work begins
- • Final payment is due upon project completion
- • All fees are in Singapore Dollars (SGD)
- • Late payments may incur additional charges
5. Cancellation and Refunds
Consultation Services: Cancellations made 48 hours before scheduled session receive full refund. Later cancellations forfeit 50% of fee.
Design Projects: Deposit is non-refundable once work begins. Cancellation after design phase incurs fees for work completed.
Our Right to Cancel: We reserve the right to cancel services if client provides false information or engages in abusive behavior.
6. Intellectual Property
All design concepts, drawings, specifications, and materials created by living elenae remain our intellectual property. Clients receive a license to implement designs for their specified project but may not:
- • Reproduce designs for other properties
- • Share or sell designs to third parties
- • Claim designs as their own creation
- • Use designs for commercial purposes without written permission
7. Warranties and Disclaimers
Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results from design implementation. Plant survival, material performance, and aesthetic satisfaction depend on factors beyond our control, including proper maintenance and environmental conditions.
While we carefully select materials and plants, we cannot warrant that all recommendations will perform identically in every environment. We provide care instructions and best practices based on professional knowledge and experience.
8. Limitation of Liability
To the maximum extent permitted by law, living elenae shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our services. Our total liability for any claim shall not exceed the amount paid for the specific service in question.
9. User Conduct
Users must not:
- • Violate any applicable laws or regulations
- • Infringe on intellectual property rights
- • Transmit harmful code or malicious software
- • Attempt unauthorized access to our systems
- • Engage in fraudulent activities
- • Harass or harm other users or our staff
10. Confidentiality
We maintain confidentiality of client information and project details. Clients similarly agree to keep our design processes, pricing, and proprietary methods confidential. We may use non-identifying project information for portfolio purposes with client permission.
11. Force Majeure
We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, supplier failures, or other unforeseeable events. Timeline extensions may apply in such circumstances.
12. Dispute Resolution
Initial Resolution: We encourage direct communication to resolve concerns informally before pursuing formal proceedings.
Mediation: If informal resolution fails, parties agree to attempt mediation before litigation or arbitration.
Jurisdiction: These terms are governed by Singapore law. Any legal proceedings shall be conducted in Singapore courts.
13. Modifications to Terms
We reserve the right to modify these terms at any time. Changes take effect upon posting to our website. Continued use of services after changes constitutes acceptance of modified terms. For active service agreements, changes apply to future projects unless otherwise specified.
14. Severability
If any provision of these terms is found unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
